Article 1 (Purpose)
These terms set out the rights and obligations, conditions of use, and responsibilities between MegaWave (the “Operator”) and users in connection with the use of WebDeck (the “Service”), which the Operator creates and operates.
Article 2 (Definitions)
- “User” means a person who accesses the Service and uses it under these terms.
- “Member” means a user who has entered into a service contract with the Operator through the Google, Apple, or email sign-in and sign-up procedure.
- “Member Data” means information a member has stored in the Service, such as the names, addresses, groups, and order of the shortcuts the member registered and personal display settings.
- “External Site” means a website operated by a third party that a user reaches through a shortcut or an advertising link.
Article 3 (Posting and Amendment of the Terms)
The Operator posts these terms in the Service so that users can easily review them. Matters not set out in these terms follow applicable law and the notices that apply to the matter, such as the Privacy Policy.
The Operator may amend the terms to the extent that it doesn't violate applicable law, and announces the reason, content, and effective date from 7 days before the effective date. Amendments that are unfavorable to users or significantly affect their rights and obligations are announced from 30 days before the effective date and are notified individually, such as to the member's registered email or through an in-service notification.
If a member doesn't agree to an amendment, the member may object or terminate the service contract before the effective date. The Operator obtains the consent needed for significant amendments and doesn't treat a member as having agreed merely because the member didn't object.
Article 4 (Formation of the Service Contract and Sign-up)
The Service sets no separate age limit. The service contract is formed when a user agrees to the Terms of Service and acknowledges the Privacy Policy on the sign-up screen, completes Google, Apple, or email sign-in, and the Operator processes the sign-up. A user who signs up or signs in with email must complete email address verification to use the Service. The purpose and scope of processing personal information needed to provide the Service follow the Privacy Policy, and where consent is required under applicable law, that procedure is followed.
The Operator may refuse sign-up or restrict use where someone has misused another person's account or provided false information, or where the sign-up harms the security or operation of the Service. If there is a technical problem, sign-up processing may be put on hold, and we will explain the reason where possible.
Article 5 (Account Management)
Members must keep their sign-in accounts, passwords, and device access safe, and must not transfer, lend, or share an account with others. If a member learns that an account has been misused or used without permission, the member must take security measures such as resetting the password and notify the Operator.
On a shared device, please sign out after use and delete the browser's site data if necessary. Responsibility for damage caused by a user's negligence in managing an account is determined under applicable law, and the Operator's responsibility isn't excluded where the Operator is at fault.
Article 6 (Content of the Service and Conditions of Use)
The Service provides registering, editing, deleting, and searching personal shortcuts, managing and sorting groups, display settings, syncing across devices, JSON import and export, and offline viewing of the saved list. The basic membership service is currently provided free of charge and may include advertising. Being free doesn't mean no advertising is shown, and no payment features are currently provided.
Saving, editing, and syncing require a server connection. Offline, you can view the list saved on that device, but it may differ from the latest information. To confirm whether data has been saved, please check the processing result the Service shows.
The limits shown on the screen or in the Service's notices apply to available storage, file size, and request frequency. Users can keep their own copy of their data using the export feature in Settings. If paid features are introduced in the future, the fees and conditions of use will be announced in advance and a separate application or consent will be obtained.
Article 7 (Obligations of the Operator and Users)
The Operator complies with applicable law and these terms, works to provide the Service reliably, and protects personal information in accordance with the Privacy Policy. Legitimate opinions and complaints about use of the Service are reviewed and handled, and progress is reported where necessary.
Users must comply with applicable law, these terms, and the Service's usage guidance, and must not do any of the following.
- Misusing another person's account or personal information, or accessing another person's data without authorization
- Infringing others' rights such as copyright, or registering or distributing illegal material
- Spreading malware, exploiting vulnerabilities, bypassing authentication, or damaging the Service or data
- Interfering with the normal operation of the Service, such as excessive automated requests or circumventing usage limits
- Using the Service to carry out activities that violate the law
Article 8 (Member Data and Rights)
The rights to Member Data belong to the member or the lawful rights holder. The Operator processes data only to the extent needed to store, sync, and back it up and to provide the features a user requests, and doesn't acquire ownership of Member Data through these terms.
Where personal information is processed in the course of delivering advertising, it follows the purposes and scope disclosed in the Privacy Policy and a lawful basis for processing under applicable law. Agreeing to these terms is not treated as blanket consent to providing your personal list or account information to advertising providers or using it for personalized advertising.
Members must hold the necessary rights to the data they register or import. Where there is a lawful report of infringement or a legal requirement, the Operator may, after the necessary review, restrict the use of or delete the relevant data, and will explain the reason unless the law prohibits it.
Article 9 (Advertising and External Sites)
To operate the Service, the Operator may place advertising on the screen, such as banners, affiliate ads, and sponsored content. The position, format, and frequency of ads may be adjusted according to how the Service is configured, and advertising or sponsored content is labeled so that users can tell it apart from the regular content of the Service. If introducing advertising causes a significant change to the conditions of use or the handling of personal information, it will be announced following the amendment procedures of these terms and the Privacy Policy.
Agreeing to the display of general advertising is distinct from agreeing to the processing of personal information for personalized advertising. The handling of personal information and your choices follow the Privacy Policy, and clicking ads or buying advertised products isn't required as a condition of using the basic Service. If advertising information is sent by email or similar means, the consent to receive it and the opt-out procedures under applicable law apply.
The Service helps you reach External Sites by showing their addresses and icons. You may also go to an External Site through an advertising link. The content of External Sites, transactions in products and services, downloads, and the handling of personal information are governed by the conditions set by the operator of that site, and registering a shortcut, showing an icon, or placing an advertisement doesn't mean a guarantee of the safety or quality of that site or advertised product.
Users must check the address and guidance of a site before visiting it. Even for damage connected with an External Site or advertiser, the Operator bears responsibility under applicable law where the Operator is at fault.
Article 10 (Restrictions on Use and Objections)
Taking into account the content and degree of a violation of these terms, whether it is repeated, and its impact on the Service, the Operator may take the measures needed, such as a warning, a temporary restriction, or termination of the service contract. The reason, scope, and period of a restriction and how to object are explained in advance.
Where immediate action is needed, such as for account misuse, a security breach, spreading service failures, or meeting a legal obligation, the Operator may restrict first and explain the reason afterward. Users can raise an objection at webdeck@megawave.app, and the Operator will review it and lift the restriction if it is justified.
Article 11 (Changes, Suspension, and Termination of the Service)
The Operator may change or temporarily suspend the Service for improvements, maintenance, security response, or operational needs. Foreseeable changes and maintenance are announced in advance, and where advance notice is difficult for unavoidable reasons such as a failure, they are announced afterward.
When ending the whole Service or discontinuing a feature that significantly affects the use of Member Data, the Operator will in principle announce the end date and how to export data 30 days ahead. Even where that period can't be secured because of a legal requirement or an urgent security reason, we will provide the reason and a way to retrieve your data where possible.
After the Service ends, personal information and Member Data are destroyed in accordance with the Privacy Policy and applicable law.
Article 12 (Member Withdrawal and Termination of the Service Contract)
Members can request to withdraw at any time through “Delete account” in Settings. To protect the account, email accounts verify identity with a password, and Google and Apple accounts must sign in again if needed. You must also type the deletion confirmation. If you can't apply directly, you can make the request at webdeck@megawave.app.
Once a withdrawal request is received, access to the member's data is blocked, and the account and personal data are deleted in accordance with the Privacy Policy. A deleted personal list can't be recovered, so please export any data you need before withdrawing. If deleting the external authentication account is delayed, follow-up processing continues until it is complete.
Withdrawal is separate from closing your Google or Apple account itself. If you sign up again, you are treated as a new member and deleted data isn't restored.
Supplementary Provisions
